Nevada Governor Steve Sisolak recently signed into law AB132, which makes it generally unlawful for employers to refuse to hire a job applicant for testing positive for marijuana on a pre-employment drug test. The law includes no similar provisions to prohibit employers from terminating or otherwise disciplining current employees for testing positive for marijuana. There are two major exceptions under the law. Certain positions are exempt, including emergency technicians such as firefighters, positions that require employees to operate a motor vehicle for which drug testing is required under state or federal law and positions that could adversely affect the safety of others. Likewise, the law does not apply to the extent that it is inconsistent or otherwise in conflict with provisions of an employment contract or collective-bargaining agreement. The law goes into effect Jan. 1, 2020.
